WHO MUST PAY THE COST OF MEDICAL EXAMINATION OF ALL WORKERS IN NIGERIA.
It is common to find employers requesting their workers to undergo medical examinations. Is this legal and if legal who should pay for such test?
Workers, employers and employment contracts/affairs are governed by federal laws including the Labour Act. Clearly, the law requires every worker that enters into an employment agreement to be medically examined by a registered medical practitioner. Furthermore, such medical examinations are to be paid for by employers and not be workers. This also extends to workers serving outside Nigeria and they must be examined in Nigeria at their last place of departure unless the Minister of Labour permits otherwise.
