The Principal Partner Kayode Ajulo & Co. Castle of Law and Chairman of the Board of Incorporated Trustees of Egalitarian Mission for Africa, Kayode Ajulo, Ph.D., has reiterated that the president of the FRN, Mr. Muhammadu Buhari has the powers to restrict the movement of persons in the country based on Health ground.

Buhari, on Sunday evening, declared State of emergency in 2 states including FCT following the rise in the number of people infected with the deadly Coronavirus pandemic.

The declaration on restricting movement in these states have sparked criticism and arguments. Some Senior lawyers, Olisa Agbokoba, SAN, Falana, SAN, Adegboruwa, SAN, Inibehe and others have said the president must resort to the provision of the Constitution before he can make such declaration.

Ajulo, who holds contrary views from other lawyers said that the state of public health and safety in the face of the looming deadly pandemic has become a bother to well-meaning Nigerians and the world at large, hence the imperative to put adequate and urgent measures in place to combat the pandemic.

In his statement made available to TheNigerialawyer(TNL), he said that the Federal Quarantine Act, CAP 384 LFN, 1990 CAP Q2 LFN 2004 which remains in force today, is the primary law governing matters concerning public health crises in Nigeria

“It is based on the exclusive legislative jurisdiction accorded to the federal government under the Constitution on issues of “quarantine” and any matter incidental thereof.

“The act empowers the President to place a curfew, impose restriction of movement, including a lockdown according to the provisions of the Quarantine Act, he said.
