The Federal High Court sitting in Ikoyi, Lagos, has ordered the remand of Gideon Bakpa Aghogho and Oscar Ebere Chukwuebuka following their arraignment over the alleged unlawful supply of access credentials capable of providing access to the database and virtual platform of First City Monument Bank.

The defendants were arraigned on Wednesday before Justice F.N. Ogazi by the Lagos Zonal Directorate 1 of the Economic and Financial Crimes Commission on an eight-count charge bordering on the alleged unlawful supply and disclosure of access credentials.

They were charged alongside a third person identified simply as Scott, who is said to be at large.

The EFCC alleged that the offences contravened Sections 27 and 28(1)(b) of the Cybercrimes (Prohibition, Prevention, Etc.) Act, 2015, as amended in 2024.

In one of the counts, the prosecution alleged that Aghogho, Chukwuebuka and Scott conspired between July 24 and 26, 2026, in Lagos to unlawfully supply Aghogho’s access code to the FCMB system through a local administrative credential identified as ITSD.

According to the charge, the credential was capable of providing access to the bank’s Virtual Center Platform and was allegedly supplied with the intention of facilitating an offence.

The count reads: “That you, GIDEON BAKPA AGHOGHO, OSCAR EBERE CHUKWUEBUKA, along with an individual identified as SCOTT (at large), conspired unlawfully between 24th and 26th July 2026 in Lagos, within the jurisdiction of this Honourable Court, by supplying for use the access code of GIDEON BAKPA AGHOGHO to the FCMB system using the local Administrative Credential (ITSD), which is capable of allowing access to the FCMB Virtual Center Platform, with the intention of committing an offence, and you thereby committed an offence contrary to Sections 27 and 28(1)(b) of the Cybercrimes (Prohibition, Prevention, Etc.) Act, 2015, as amended in 2024, and punishable under Section 28(2) of the same Act.”

Another count alleged that Aghogho, between April and May 2025 in Lagos, knowingly and without authority disclosed access credentials relating to the bank’s systems.

The EFCC alleged that the credentials included FCMB’s server IP and domain details and were supplied to enable access to the bank’s database.

The prosecution further alleged that the disclosure was made in exchange for $15,000.

When the charges were read to the defendants, Aghogho, the first defendant, pleaded not guilty, while Chukwuebuka, the second defendant, pleaded guilty.

Following Aghogho’s plea, EFCC prosecution counsel, Bilkisu Buhari, asked the court to fix a date for the commencement of trial and requested that the defendant be remanded in a correctional facility pending further proceedings.

In respect of Chukwuebuka, the prosecution sought permission to review the facts of the case following his guilty plea.

Justice Ogazi subsequently adjourned the matter until August 27, 2026, for the review of facts in relation to the second defendant and for other proceedings in the case.

The judge also ordered that both defendants be remanded in a correctional centre pending the next adjourned date.

Scott, who was named alongside the defendants in the charge, remains at large.

The allegations against Aghogho have not been proven, as he pleaded not guilty and is entitled to the presumption of innocence until the court determines the charges against him. Chukwuebuka’s guilty plea is also subject to the court’s formal review of the prosecution’s facts and further orders at the next proceedings.
