The Attorney General of the Federation (AGF) and Minister of Justice, Prince Lateef Fagbemi (SAN), has described electronic and digital evidence as indispensable to the administration of justice in an era where transactions, communications, and disputes are increasingly technology-driven.

Fagbemi stated this in a message at the public presentation of Electronic Evidence (Second Edition), A Compendium of Cases on Electronic Evidence, Volume 2 (2020–2025), and the launch of the Justice Alaba Omolaye-Ajileye Educational Foundation for Indigent Students in Abuja on Thursday.

According to the AGF, “In today’s age, where transactions, communications and disputes are increasingly conducted electronically or defined by technology, the ability of our courts to admit and interpret electronic evidence is indispensable to the administration of justice.”

Represented by the Solicitor General of the Federation and Permanent Secretary, Ministry of Justice, Mrs Beatrice Jeddy-Agba, the AGF reaffirmed the Federal Government’s commitment to making education accessible to all.

Also speaking, the Director-General of the Department of State Services (DSS), Mr Oluwatosin Ajayi, appealed to legal practitioners and stakeholders to support the prosecution of cybercrime offences, including through amicus curiae (friends of the court) interventions where appropriate.

“If you convict one person, that has an impact; others will be picked up,” he said, adding that society would only change when offenders are held accountable under the law.

He also condemned defamatory online attacks against individuals, warning that failure to punish such conduct could embolden offenders to escalate from verbal abuse to physical violence.

In his remarks, the Father of the Day, Chief Wole Olanipekun (SAN), challenged the retired jurist to expand his research beyond electronic evidence to include Nigeria’s Cybercrimes Act, which he described as an area requiring deeper scholarly interrogation.

He expressed concern over what he considered gaps in the implementation and interpretation of the law and urged Justice Ajileye to deploy his academic expertise to strengthen jurisprudence on cybercrime.

In his address, former AGF and Minister of Justice, Chief Kanu Agabi (SAN), called on the Director-General of the DSS and the Chairman of the EFCC to go after the stolen billions of naira belonging to the country that are stashed abroad.

“Let us use whatever it takes to bring back the looted money to Nigeria,” Agabi said, adding that Justice Ajileye would be remembered for the judgments he delivered while on the bench.

Also speaking, the EFCC Chairman, Mr Ola Olukoyede, said the Commission is going after “Yahoo Yahoo” boys because of their activities, which he described as being as harmful as treasury looters.

He called on Nigerians to join hands with the Commission in the fight against financial and economic crimes.

The EFCC boss said the Commission needs a law that would support the use of Artificial Intelligence (AI) technology in investigations and the generation of evidence.

The author, Justice Alaba Omolaye-Ajileye, in his vote of thanks, raised concerns over the perceived inconsistency in the alterations to the Electoral Act.

Questioning the rationale behind the differing approaches, he argued that if election officials are expected to wait for network connectivity during voter accreditation, the same principle should apply to the electronic transmission of results instead of immediately resorting to manual procedures.

He maintained that network failures are often temporary and could be resolved within a short time, making it unnecessary to abandon electronic transmission prematurely.

The event brought together senior judicial officers, legal practitioners, academics, security chiefs, and other stakeholders to celebrate Justice Ajileye’s contributions to legal scholarship and the advancement of technology-driven justice in Nigeria.
