The Peoples Democratic Party (PDP) has approached the Federal High Court in Abuja, seeking an order for the removal of Hon. Oluwole Oke from the House of Representatives over his recent defection to the All Progressives Congress (APC).

In a suit filed on Monday by its counsel, Raphael Oyewole, the PDP asked the court to compel the Speaker of the House of Representatives, Rt. Hon. Tajudeen Abbas, to immediately declare the Obokun/Oriade Federal Constituency seat vacant in line with Section 68(1)(g) and (2) of the 1999 Constitution (as amended).

The party argued that Oke’s defection was not backed by any credible evidence of division, merger, or faction within the PDP — a constitutional prerequisite for cross-carpeting by elected lawmakers.

The suit, marked FHC/ABJ/CS/1040/2025, lists Oke, the Speaker of the House, the Clerk of the National Assembly, and the Independent National Electoral Commission (INEC) as the 1st to 5th defendants respectively.

The PDP also urged the court to direct the Clerk of the National Assembly to cease all salary and benefit payments to Oke, and to compel him to refund all emoluments received from the date of his resignation from the PDP.

Specifically, the party is seeking:

  • An order of mandamus compelling the Speaker to declare Oke’s seat vacant;
  • An order directing INEC to conduct a bye-election in the constituency;
  • An order compelling Oke to refund all salaries and allowances received since defecting;
  • A declaration that Oke has forfeited his legislative seat in accordance with the constitution.

Oke, a six-term lawmaker, announced his defection from the PDP in a letter dated April 16, 2025, addressed to the party’s ward chairman in Obokun Local Government Area of Osun State. He cited consultations with political associates and family members as reasons for his move to the APC.

The matter is yet to be assigned to a judge.
