A Nigerian lawyer, Maxwell Opara, Esq., has accused the Judiciary Staff Union of Nigeria (JUSUN) Nasarawa State Chapter of hiding the identities of magistrates that allegedly issued fraudulent court orders related to his client’s bank account.

Opara criticized the union for claiming ignorance about the magistrates in Mararaba and Masaka who issued an order, calling it a regrettable move that obstructs transparency and accountability.

In a scathing commentary, Opara emphasized that an organization like JUSUN, tasked with safeguarding the interests of the masses, should not be implicated in concealing the truth. He expressed his dismay that the union denied knowledge of an order that is a public document and has garnered global media attention.

In forwarding copies of the various controversial orders to TheNigerialawyer, Opara, highlighted that the initial order was granted ex-parte, emphasizing on the obligation to put the opposing party on notice, which, according to him, the Police failed to fulfill.

This is the first order containing the wrong account number from Maraba Magistrate Court, which they used to place PND on my client’s account with Access Bank.

Furthermore, Opara detailed a subsequent order issued on November 2nd, by Magistrate V. V Manga, Esq, of Mararaba Magistrate Court where he set aside his previous order on grounds of fraud, and Access Bank’s non-compliance.

Opara, shed light on an additional order obtained on November 6th, suggesting alleged improper actions by the police in scouting various courts in Abuja.

This is the order from the same Maraba Magistrate Court issued on the 2nd of November 2023 to vacate the court order for the PND placed on my client’s account.

Describing the sequence of events, Opara recounted an incident where the police revisited Mararaba Magistrate Courts after facing refusal from a magistrate. Undeterred, they proceeded to the Masaka Magistrate Court, where the Magistrate, Emmanuel Jatau, Esq, issued an order for them to fraudulently moved out 20 million Naira from his client’s account.

This is the order they obtained on November 6, 2023, from Masaka Magistrate Court, which they fraudulently used to withdraw N20m from my client’s account (GoodLuck Ebere Emmanuel).

The lawyer further accused Access Bank of criminal complicity by complying with the allegedly fraudulent orders instead of waiting for the High Court to decide on the originating motion regarding the disputed funds that was filed by his client.

Opara, who said he is on a short holiday in the United Kingdom, anticipating his return to Nigeria by Friday, expressed readiness to engage in a conference call or debate to address the matter comprehensively. He affirmed his commitment to confronting the issues with documented evidence, emphasizing the need for a fair and lawful resolution.

In conclusion, Opara highlighted the lack of proper investigation into the allegations, stating that due process was not followed. He emphasized the need to adhere to the correct legal procedures, pointing out that under the new Administration of Criminal Justice Act (ACJA), the police should file charges and arraign suspects before applying for court orders.
