Daily Law Tips (Tip 362) by Onyekachi Umah, Esq., LLM. ACIArb(UK)
WHEN CAN ANY ORDINARY PERSON ARREST A CRIMINAL SUSPECT IN NIGERIA.
Arrest of criminal suspects is not to police officers alone. Any private person, ordinary person, non-uniformed or trained person can arrest a criminal suspect in Nigeria, if such private person witnessed a suspect committing an offence in the presence of such private person. Also a private person can arrest a suspect where such private person has good reasons to believe that a suspect committed an offence, an offence that even police can arrest such suspect for, without a warrant. To learn the 12 instances where police can arrest without warrant, kindly see “Daily Law Tips” (Tip 350) of 17 June 2019.
My authorities are sections 20, 494 and 495 of the Administration of Criminal Justice Act, 2015 and other similar laws across States in Nigeria.
