The Nigerian Bar Association (NBA) has strongly condemned the Nigeria Police Force’s announcement to resume enforcement of the controversial tinted glass permit policy, describing the move as a “reckless overreach” that undermines the authority of the courts and imposes undue financial hardship on citizens.

In a press release issued by NBA President, Mazi Afam Osigwe, SAN, the association criticized the statement dated 15th December 2025 from the Force Public Relations Officer, CSP Benjamin Hundeyin, which confirmed that enforcement of the policy would resume from 2nd January 2026. The NBA said this announcement “portrays the Police as lacking respect for the rule of law, due process, and the authority of the courts.”

The NBA recounted that in April 2025, the Inspector General of Police (IGP) had introduced the tinted glass permit policy through an online platform, initially set for enforcement in June and later postponed to October. The policy had been widely criticized for reports of harassment, extortion, and violations of civil rights.

In response, the NBA, through its Section on Public Interest and Development Law (NBA-SPIDEL), filed a suit at the Federal High Court, Abuja (Suit No: FHC/ABJ/CS/1821/2025), challenging the legality and constitutionality of the policy. The suit argued that the policy:

  • Was based on an outdated 1991 military-era law not compliant with the 1999 Constitution;
  • Lacked legislative authority;
  • Risked creating disorder and extortion;
  • Generated revenue for private interests outside lawful police functions; and
  • Added unnecessary financial burden to Nigerians and businesses.

Following public outcry and court intervention, the IGP suspended enforcement of the policy pending judicial determination. NBA representatives, including Mazi Afam Osigwe, SAN, had engaged with the Police leadership to ensure compliance with court orders.

The NBA noted that the Federal High Court proceedings on 12th December 2025 confirmed the suspension of enforcement, and the Motion for Interlocutory Injunction was struck out based on assurances from the Police’s legal counsel, Chief Ayotunde Ogunleye, SAN.

“The sudden announcement to resume enforcement barely a day after the Court relied on the Police’s undertaking is deeply disturbing,” the NBA said. “It constitutes contempt of court, a breach of due process, and a threat to citizens’ rights.”

The NBA has called on the Inspector General of Police to immediately withdraw the statement and halt any enforcement of the tinted glass permit policy until all related court matters are finally determined. The association also directed all NBA branches and the NBA Human Rights Committee to provide legal support to any citizen affected by attempts to enforce the policy.

Failure by the Police to comply, the NBA warned, could result in committal proceedings against the IGP, the Force Public Relations Officer, and any counsel found to have misled the Court.
