The Court of Appeal sitting in Kano on Monday ordered the Nigerian Correctional Service to produce Islamic cleric Sheikh Abduljabar Kabara for the hearing of his appeal against a death sentence.

Kabara is currently in custody following a judgment by an Upper Shari’a Court which sentenced him to death by hanging over alleged blasphemy.

At the resumed proceedings, the presiding judge, Justice Mohammed Lawal-Shuaibu, held that since the appellant filed his appeal personally without legal representation, he must appear in court to prosecute the matter himself.

“In view that the appellant filed the appeal in person and not through counsel, he is to appear personally. Also, in view of the fact that the appellant is in custody, it is hereby ordered that the Correctional Service produce him on the next adjourned date,” the court ruled.

The appellate court consequently directed that Kabara be produced on April 23, 2026, for the hearing of his appeal.

The panel also included Justice Abubakar Muazu-Lamido and Justice Ahmad Ramat-Mohammed.

Earlier in the proceedings, both parties were absent and unrepresented. A man, Usman Malam-Hussaini, appeared before the court claiming he had been sent by the appellant with a letter requesting his transfer from Kuje Prison to Kano to enable him access relevant documents for his defence.

The court, however, directed the Attorney General and Commissioner for Justice in Kano State, Abdulkarim Kabiru-Maude, to appear and explain the situation, temporarily standing down the matter.

When the case was recalled, the Assistant Director of Public Prosecutions, Barrister Zahradeen Kofar-Mata, informed the court that the Attorney General was indisposed and conveyed his apology, attributing the absence to a mix-up at the registry.

Justice Lawal-Shuaibu cautioned the Attorney General over what he described as a lack of respect for the court due to his absence, before adjourning the matter to April 23, 2026, for hearing.
