The High Court of Anambra State sitting at Neni has upheld the election of the Agulu Peoples Union which was conducted on December 30, 2020 and nullified the current Caretaker Committee constituted by the Anambra State Government.

The election had produced Chief Oliver AFAMEFUNA as president and Hon. Okeke Sylvester and  Emeka Okafor as first and second Vice Presidents of the Union respectively. Charles Ezie on the other hand was elected as the secretary.

The President-General of Agulu Peoples Union (APU)  Chief Oliver Afamefuna, in a statement made available to TheNigeriaLawyer said judgement is a win for the Union.

TheNigeriaLawyer recalls that Agulu Peoples’ Union on 30th December, 2020 conducted an election which was duly done in accordance with the extant Constitution of the Agulu Peoples Union produced the following as its officers.

President General: Chief Oliver Afamefuna 1st Vice President General: Hon. Okeke Sylvester, 2nd Vice President General: Emeka Okafor, National Secretary: Charles Ezie, Assistant National Secretary: Orafu Chiemezie, National Treasurer: Ekene Emegwamuo, National Financial Secretary: Dr. Afam Emmanuel Dueze (Jnr), National Publicity Secretary:   Chinazo Onwuazombe, Chief National Provost: jerry Nduka, National Assistant provost: Alex Okoye, National Assistant provost: Osita Udekwe, National Assistant provost: Aguluka Nwandu Kingsley.

Most unfortunately, certain unscrupulous elements within the community, in their bid to cause confusion and crisis within Agulu, connived with Government of Anambra State so as to subvert the will of the Agulu people as expressed in the ballot. With the intervention of the Anambra State Government, “Caretaker Committee” was arbitrarily set up to forcefully administer the affairs of Agulu Peoples’ Union.

Peeved by this ugly development, the people of Agulu promptly galvanized support for the Chief Oliver Afamefuna/Hon. Slyvester Okeke led administration of Agulu Peoples Union. This culminated into a law suit challenging the legitimacy of the usurpers pretending to be the “Caretaker Committee” of the Agulu Peoples Union.

As part of their antics during the pendency of the Suit at Neni High Court, the defendants sought to intimidate the presiding judge by writing a spurious petition against Hon. Justice G.C Anulude. As rightly expected, the Judex did to give in to this intimidation.

Despite the order of the Neni High Court granted by Hon. Justice G.C Anulude mandating the parties to maintain status quo ante bellum pending the hearing and determination of the suit challenging the illegitimate “Caretaker Committee” constituted by the Anambra State Government, the said “Caretaker Committee” was hell-bent on conducting yet another election so as to make a mockery of the mandate entrusted to the Chief Oliver Afamefuna/Hon. Slyvester Okeke led administration of Agulu Peoples Union.

Once the elected 1st Vice President General of Agulu- Hon. Slyvester Okeke Peoples’ Union got wind of this secret plan by this illegitimate “Caretaker Committee” to conduct a parallel election, he promptly approached the court through his counsel- Alex Ejesieme, SAN. In view of the real urgency demanded by the circumstance, bearing in mind the fact that the secret plan of these usurpers was to conduct their parallel election during the Christmas Vacation period; the honourable court- per Hon. Justice Okey Onunkwo, upon the application of  Hon. Slyvester Okeke, granted a prohibitory order restraining the usurpers from conducting another election pending the hearing and determination of the substantive suit which bothers on the tenure of office of elected executive Committee of A.P.U.

The grant of this restraining order of injunction by Hon. Justice Okey Onunkwo spurred the usurpers into writing yet another petition disparaging the judge and even threatening to “sack” the judge through the instrumentality of the National Judicial Council. 

The President General, Chief Oliver Afamefuna, said: “Fortunately, the fearless judge was not known as one who easily succumbs to threats and intimidation. Rather the judge upon learning about the pendency of the petition, revealed it openly in court. 

“As cowardly as they were, the usurpers and their counsel- Kingsley Awuka Esq. denied knowledge of the scathing petition despite the fact that the said petition was written with the letter-head of Kingsley Awuka Esq. with a lawyers Stamp and seal firmly affixed thereto.

“As the saying goes, there is an end to every beginning. 

“Today marks the end of the inglorious reign of the usurpers to the leadership of Agulu Peoples Union. In the hotly contested case, in Suit No. NN/64/2021 between Chief Oliver Afamefuna and other elected Executive officers of the A.P.U versus the illegitimate Caretaker Committee and their paymaster- the Anambra State Government; Hon. Justice G.C Anulude of the Neni High Court found in favour of the Chief Oliver Afamefuna led administration of A.P.U and thereupon nullified the appointment of the Caretaker Committee by the Anambra State Government. ”

According to the court, the Anambra State Government lacks the authority to interfere with or cancel a peaceful election of a Town Union conducted in accordance with the law. 

This judgment has in effect vindicated Hon. Justice Okey Onunkwo. It is also a win for the Agulu People.
