The Rivers State High Court sitting in Port Harcourt has ordered the Nigerian Ports Authority and International Container Terminal Services Nigeria Limited to suspend all dealings and activities concerning Berth 12 at the Federal Ocean Terminal, Onne Port Complex.

The order was made on July 17, 2026, in Suit No. NHC/1/CS/2025, instituted by Deep Offshore Services Nigeria Limited against the NPA and ICTSI Nigeria Limited.

The court directed the parties to preserve the existing condition of Berth 12 by refraining from any action capable of altering the subject matter of the dispute until it rules on the pending applications.

Counsel to the claimant, Ama Etuwewe, SAN, said the court specifically directed all parties to “stay all actions relating to the subject matter of this suit until the ruling on the motions after vacation.”

The pending applications have been adjourned until September 23, 2026, for ruling.

By the court’s directive, none of the parties is permitted to execute a new lease agreement, grant fresh rights or interests over the facility, undertake construction work, take possession, commence development or carry out any activity capable of changing the status quo at Berth 12.

The order effectively places all proposed commercial, operational and developmental activities concerning the disputed facility on hold until the court determines the pending applications or varies the directive.

Etuwewe warned investors, financial institutions, contractors, prospective lessees, buyers, government agencies and other stakeholders against entering into transactions involving Berth 12 while the court order remains in force.

The senior advocate said any lease, assignment, financing arrangement, memorandum of understanding, sale, sublease or similar transaction executed in violation of the subsisting order could be declared null and void.

He added that transactions undertaken in breach of the directive might confer no enforceable legal rights or protection on the parties involved.

Etuwewe further warned that any deliberate disobedience of the court’s order could expose the affected individuals or organisations to contempt proceedings and other legal consequences.

The order was made to preserve the subject matter of the dispute and prevent any of the parties from creating new interests or taking steps that could undermine the court’s eventual decision.

All parties and stakeholders have consequently been advised to avoid any dealings relating to Berth 12 until the pending applications are determined on September 23, 2026, or the order is otherwise varied by the court.
