The Economic and Financial Crimes Commission (EFCC) has submitted a counter-affidavit at the Federal High Court Abuja, opposing a suit seeking to challenge the appointment of its Chairman.

In the suit filed by plaintiff Maxwell Opara, with Suit No:. FHC/ABJ/ CS/ 1410/2023, against the President, Attorney General of the Federation and others, the claimant disputes the competency of Chief Olanipekun Olukoyede as EFCC Chairman.
However, the anti-graft agency in its affidavit deposed by Litigation Officer Ezire Ufuoma dismissed the allegations as speculative, untrue and lacking merit. The EFCC contended that the plaintiff lacks locus standi and his suit is frivolous, vexatious and designed to distract the Commission from discharging its duties diligently.
In its counter affidavit, the Commission described Maxwell as ”Mere Busybody”; “An Interloper”; “Knight errant”; “an adventure”; “a non-tax paying individual “; “a rabble rouser”; “gold digger”; “an irritant” – expressing its lack of regard for the plaintiff’s criticisms.
Information supplied by the agency’s counsel Sylvanus Tahir SAN formed part of the basis for the counter-affidavit, expressing confidence in Chief Olukoyede’s capacity to carry out his duties as Chairman. Among others, the deponent stated that contrary to the plaintiff’s claims, due process was followed in the appointment of the EFCC Chairman who is qualified for the role.
With the parties submitting their arguments, the suit will now proceed to determination by the court.
While Maxwell Opara is seeking to challenge Olukoyede’s appointment, the EFCC has urged for the case to be dismissed outright. The court’s ruling will determine the Chairman’s legitimacy going forward.
