DAILY LAW TIPS (Tip 361) by Onyekachi Umah, Esq., LLM. ACIArb(UK)

HOW TO BE EXEMPTED FROM ELECTRICITY DISCONNECTION IN ANY PART OF NIGERIA EVEN WHEN OWING DEBT FOR CONSUMED ELECTRICITY .

Ordinarily, where a customer is owing electricity bill such customer may be disconnected from electricity supply by the electricity Distribution Company (DisCo) in charge of his area.
There are situations where a customer may be owing electricity but the DisCo CANNOT and is NOT permitted by the Nigerian Electricity Regulatory Commission (NERC) to disconnected such customer from supply of electricity.
The situations are where;
Customer has paid the amount billed/charged.
Customer has obtained a payment arrangement with the DisCo and adheres to it.
The amount owed by customer is less than the value of the customer’s monthly consumption
Customer made a complaint concerning a bill to the Nigerian Electricity Regulatory Commission (NERC) through its Customers Complaints Procedure and same has not been resolved.
Customer has applied for assistance from the Power Consumer Assistance Fund (PCAF) or any other consumer welfare mechanism and same has not been resolved.
The part of the electricity bill that has not been paid is not the cost for “Sale of Energy” but something like the cost for “Meter Maintenance“.
There is life support machine in use in the premises, and the DisCo is aware of such.

For any of the reasons above, no DisCO can disconnect any customer from electricity supply. Kindly report any such illegal disconnection or practises to Nigerian Electricity Regulation Commission (NERC) or speak to your lawyer.

My authorities are Regulations 10 and 14 of the Nigerian Electricity Regulatory Commission’s Connection and Disconnection Procedures for Electricity Services, 2007.
