The substance of the complaint is to the effect there was no election on the 30th of June 2017 that has any semblance of an election under the NBA Bye-law, thereby, calling upon the appropriate authorities to ignite its powers. The particulars of the complaint provide inter alia that (1) The electoral committee was set up in January, 2017 contrary to paragraph 17 (1) of the NBA Uniform Bye-Law. (2) That the list of eligible voters was not published 14 days before the date of election. (3) That there was no list of eligible voters in the morning of the election published at all. Accordingly, the voting did not commence and/or concluded. Closely supporting paragraph 3 of the particulars are facts so stated inter alia that on the 28th June, 2017 the electoral committee issued a signed list of candidates qualified for the election. It was posted on the notice board of the NBA, Aba Branch. In the same notice board was an unsigned list of several names which had no heading. That on the floor of the Annual General Meeting on that day, the chairman of the NBA, Aba Branch did not allow for the presentation of the financial report of the branch by the financial secretary, which means that for two years there has not been any official list of financial members of the NBA Aba branch, and as such the undersigned sought to know how and who posted the unsigned list of names on the notice board; that it turned out to be the secretary of the branch and not the electoral committee. That it was agreed that the candidates and/or their representatives would meet in the morning of 29th day of June, 2017 to verity the names on the list and that this is against the background that the list had several names that were not members of the branch, other names of persons that were duplicated and several names of which were excluded. That the verification was scheduled to commence by 8: 00 am on 29th day June, 2017 at the Bar Center, but it did not start until 12:20 pm because members of the Electoral Committee failed to come on time. Howbeit the verification was done up to 90 percent when at about 7 : 00 pm it was agreed that it would be completed the next day, being 30th day of June, 2017 which was the day of election. That by the next day, the electoral committee had, in the handwriting of an unidentified person added about 160 names in the list which was being clutched by the chairman of the Electoral Committee. Immediately members noticed that there was no definitive list of eligible voters, protest commenced and this continued till 6: 00 pm; that there no accreditation, voting or any result announced and no certificate of return issued. The complaint which contained further facts in support included a paragraph of other infractions such as the clearance of aspirants who did not pay their practicing fees and branch dues, and that the notice that called for nominations did not include the officers of the legal adviser and provost and also that the legal adviser to the Abia state Governor, Emeka Eze Esq., in paid employment was cleared to stand for election as social secretary. The complaint also contained a paragraph for background supporting their claim and in conclusion prayed that a wrong precedent is not laid, that the said paragraph 11 (1) of the NBA Uniform Bye-Laws for branches be invoked and finally that the office direct an appropriate list of eligible voters be prepared and election conducted immediately. ]]>
