The Federal High Court sitting in Lagos has directed that businessman and social media influencer Afolabi Michael Kazeem, popularly known as KC Luxury, be returned to the hospital after he was brought to court in an ambulance while receiving oxygen.

Justice Musa Kakaki gave the directive on Friday after a nurse attending to Kazeem informed the court that his medical condition made it unsafe to move him from the ambulance into the courtroom.

The development occurred during proceedings in which the defence was also pursuing a fresh bail application seeking Kazeem’s release to enable him obtain specialised medical treatment.

Bukki Yahya, a nurse from the Police Hospital, Falomo, Lagos, told the court that Kazeem had been admitted to the hospital on October 7, 2026, and diagnosed with asthma and sepsis.

“My Lord, I am Bukki Yahya, the nurse attending to the patient, Afolabi. He was diagnosed with asthma and sepsis when he was brought to the Police Hospital, Falomo.

“He is inside the ambulance in the court premises, but we can’t move him here because he is with oxygen,” she told the court.

The nurse was called to address the court after a correctional officer informed Justice Kakaki that the defendant was critically ill and had been hospitalised.

Following the explanation, Kazeem’s counsel, Chief Emefo Etudo, questioned the decision to bring his client to court despite his condition.

“If, for instance, the defendant was in the intensive care unit and is like this, why should they bring him to court?” the lawyer asked.

Justice Kakaki thereafter ordered that the defendant be taken back to the hospital.

“You can take him back to the hospital,” the judge said.

The court then proceeded to hear arguments on Kazeem’s fresh bail application.

Etudo told the court that his client’s condition had deteriorated and alleged that he had suffered a lung collapse requiring specialist medical attention.

The defence counsel further submitted that the Police Hospital had referred Kazeem to the Lagos University Teaching Hospital because it lacked the facilities required to surgically manage his condition.

Etudo also alleged that despite the referral, Kazeem was withdrawn from LUTH and taken to a correctional centre on October 13.

According to the defence, the defendant’s health deteriorated while he was being conveyed to the correctional facility, forcing those accompanying him to return him to the Police Hospital, where he was subsequently admitted to the intensive care unit.

On that basis, the defence urged the court to grant bail on liberal terms to enable Kazeem receive specialised treatment.

Etudo assured the court that his client would attend subsequent proceedings and added that Kazeem’s international passport was already in the custody of the authorities.

The prosecution, however, opposed the fresh bail application.

Prosecution counsel Abu Ibrahim argued that the medical issues relied upon by the defence had substantially been considered by the court in an earlier ruling.

Ibrahim maintained that the defendant’s underlying ailment remained asthma, although the condition might have become more acute.

He also faulted the defence for allegedly failing to produce medical documentation from LUTH establishing that the hospital was unable to manage Kazeem’s condition.

The prosecution urged the court to dismiss the application, contending that the defendant was a flight risk.

Ibrahim further asked the court to impose stringent conditions should it decide to grant bail.

After hearing arguments from both sides, Justice Kakaki adjourned ruling on the fresh bail application until October 28, 2026.

Kazeem is standing trial alongside Boniface Freeman Ochoche Sule and Ikechukwu Ekugo Patriarch on a 22-count charge involving allegations of conspiracy to export 184.5 kilogrammes of cocaine to the United Kingdom and money laundering.

All three defendants have pleaded not guilty to the charges.
