WHAT POLICE MUST DO WHEN THERE IS NO EVIDENCE AGAINST AN ARRESTED PERSON.

When any suspect is arrested and handed over to police, it is the duty of police to investigate the matter and immediately release the suspect where there is no sufficient reason to believe the suspect committed an offence. Note that, even where there is reason to believe a suspect committed an offence, such reason must be sufficient, adequate, enough and compelling to prove the offence.

My authorities are sections 23(6), 494 and 495 of the Administration of Criminal Justice Act, 2015 and other similar laws across States in Nigeria.
