TIME WITHIN WHICH PERSON ARRESTED BY “CIVILIANS” MUST BE HANDED OVER TO POLICE.
Where a suspect is arrested by a private person (not a security officer) without a warrant, the arresting person must immediately hand over the suspect to a police officer or to the nearest police station, where there is no police officer around.
Where a police officer takes over an arrested person from a private person, the police officer must make a note of the name, address and other particulars to the person that made the arrest.
“Civilians” is used here to include private persons, who are not police officers or any security officer.
My authorities are sections 23(1), 494 and 495 of the Administration of Criminal Justice Act, 2015 and other similar laws across States in Nigeria.
