Kano High Court on Thursday ordered that one Ayuba Musa, (23), an SS 2 Student in Bebeji local government should proceed to spend 14 years in jail for having sexual intercourse with an under aged girl (name withheld).

The court sitting at Audu Bako Secretariat in the state capital said the prosecution had adduced the requisite evidence to convince the court to convict Ayuba for the alleged offence filed against him.

The prosecution had told the court that the convict, on April 19, 2017 had lured his victim into his private room which was located at Ruwan Kaya Quarters in Tiga Village, Bebeji LGA.

In her testimony before the court, the 10-year old girl told the court that when the convict lured her into his room, he turned on a television set and then asked her to fondle his private part.

She further revealed that Ayuba removed her pant and then penetrated her private part using his penis. She said during the penetration she felt a sharp pain.

According to the victim, the pain was unbearable and continued until she got home where, responding to queries from her mother, and she narrated what transpired, after which the matter was reported to the police, the court heard.

Ayuba denied all the allegations slammed against him, but when convicted, he prayed the court for leniency, noting that he is an SS 2 student, adding that he caters for his mother who was old and sick.

The Court held that the victim in her testimony was unshaken, even when under rigorous cross-examination, noting that she was a witness of truth.

The court further noted that the report and testimony given by the police during investigation corroborated one another and that the defendant through his defense counsel could not discredit the testimonies that were given against him.

Justice A. T. Badamasi in his judgement said he has no doubt in his mind that the prosecution has proven its case beyond reasonable doubt.

He said a case of rape has been proven against Ayuba, and ruled that the secondary school student should proceed to serve 14 years in jail without an option of fine.
