The Federal High Court in Abuja has dismissed the no-case submission filed by former Kaduna State Governor Nasir El-Rufai and ordered him to enter his defence in the trial over the alleged unlawful interception of telephone communications involving the National Security Adviser, Nuhu Ribadu.

Justice Joyce Abdulmalik gave the ruling after holding that the prosecution had presented sufficient evidence to require El-Rufai to respond to the allegations against him.

The court consequently rejected El-Rufai’s contention that the prosecution had failed to establish a case warranting his defence.

Justice Abdulmalik held that the evidence placed before the court by the prosecution was sufficient at this stage of the proceedings to call on the former governor to enter his defence, if he so desired.

The ruling on the no-case submission does not amount to a finding that El-Rufai is guilty of the allegations. It means only that the court found sufficient evidence requiring him to respond to the prosecution’s case.

The former Kaduna governor is standing trial over allegations relating to the unlawful interception of Ribadu’s telephone communications.

Following the ruling, Justice Abdulmalik adjourned the matter to November 25, 2026, for El-Rufai to open his defence.
