The National Executive Council, NEC, of the Nigerian Bar Association, NBA, has called for improved welfare, remuneration and working conditions for judicial officers across Nigeria.

The resolution was adopted at the NBA NEC meeting held in Awka, Anambra State.

NEC expressed deep concern over reports of poor welfare conditions affecting judicial officers, including the reported incident involving a Customary Court President in Ondo State who was allegedly involved in an accident while using commercial transportation due to inadequate welfare support.

The Council described the incident as troubling and reflective of wider systemic failures affecting the independence, dignity and effectiveness of the judiciary.

According to NEC, judicial officers occupy a central position in the administration of justice and cannot be expected to effectively discharge their constitutional responsibilities under poor welfare and working conditions.

The Council stressed that adequate remuneration, security, transportation and general welfare for judicial officers are constitutional imperatives necessary to safeguard judicial independence and sustain public confidence in the justice system.

NEC therefore called on state governments, including the Ondo State Government, as well as relevant federal authorities, to prioritise improved welfare and working conditions for judicial officers nationwide.

The Council also reaffirmed the NBA’s readiness to engage constructively with relevant stakeholders in pursuit of sustainable reforms aimed at protecting the dignity and independence of the judiciary.

In another resolution, NBA NEC raised concern over the arrest, prosecution and remand of a social media content creator popularly known as “Justice Crack” following the circulation of a viral video concerning alleged poor feeding conditions for soldiers.

NEC said the development raises important constitutional questions on the balance between national security considerations and citizens’ rights to freedom of expression, personal liberty and access to information.

While acknowledging the importance of military discipline and operational security, the Council maintained that any response to public disclosures must be grounded in law and consistent with constitutional safeguards and due process.

NEC warned against the use of arrest, detention and criminal prosecution in circumstances that may amount to suppression of lawful expression or intimidation of citizens.

The Council stressed that constitutional rights may only be restricted within limits reasonably justifiable in a democratic society and in strict compliance with the law.

It therefore called on relevant authorities to ensure that all actions taken in the matter comply fully with constitutional safeguards, due process requirements, and the principles of legality and proportionality.
