A Delta State High Court sitting in the Ekpan Judicial Division, Uvwie Local Government Area, has restrained Governor Sheriff Oborevwori and the Attorney-General of the state over a land dispute in Ekpan.

Also restrained is Dr Kennedy Omonuwa from the late Vincent Onome Omonuwa’s family. This development followed a motion ex parte brought before the court by C. U. Umode Esq., on behalf of Chief Mathias Ote and Samuel Akpomejeme (for themselves and on behalf of the members of the Akpomejeme family of Ekpan) as claimants/applicants in Suit No: HCE/26/2025 against the defendants.

The presiding judge, Hon. Justice Michael Nduka Obi, in Suit No: HCE/26/2025, delivered the ruling on Tuesday, 7th August.

According to the court’s enrolment order: “An order of interim injunction restraining the defendants either by themselves or through their agents, servants, workmen and/or contractors from further tampering with and/or renovating the bungalow building of the Akpomejeme family house situated on Egbesaba land along Refinery Road, Ekpan, opposite the Nigerian Navy in Uvwie Local Government Area of Delta State, pending the hearing and determination of the motion on notice filed in this suit.

“An order of interim injunction restraining the defendants either by themselves or through their agents, servants, workmen and/or contractors from embarking on any act of development, including the erection of any wall fence and/or construction of any concrete structure with granites, cement and blocks, that could alter the Egbesaba land along Refinery Road, Ekpan, opposite the Nigerian Navy, pending the hearing and determination of the motion on notice filed in this suit.

“And for such further order or other orders as this honourable court may deem fit to make in the circumstances.”

The matter came up for hearing before Hon. Justice Michael Nduka Obi, sitting at the High Court, Ekpan Judicial Division, on Tuesday, 7th August 2025.

The judge ruled: “The applicants being absent, and the court having heard C. U. Umode Esq. for the applicants, hereby orders as follows: Accordingly, prayers 1 and 2 on the motion paper are granted as prayed, in view of the urgency deposed to in the affidavit of urgency. The motion on notice is hereby fixed for 18/08/2025.”

In a statement sent to our correspondent on Sunday afternoon, 10th August, C. U. Umode Esq. alleged that workers, suspected to be government contractors and workmen, were seen working on the disputed land as of Saturday, 9th August.

He stated that he would continue to seek the court’s intervention in addressing what he described as oppression, disobedience to court orders, and injustice by government officials and others involved.
