The Governor of Lagos State, Mr. Babajide Olusola Sanwo-Olu has delegated the powers conferred on him under Sections 21 (a), 22 and 23 of the land Use Act to five commissioners in the state.

This is contained in a Legal Notice (NO. LN/BOS/001 of 2019), dated the 25th day of September, 2019, signed by His Excellency, the Executive Governor and made available to TheNigerialawyer (TNL).

According to the notice, the powers specifically listed in Schedule 1 to the notice are delegated to the following commissioners to wit:

i. Mr. Moyosore Onigbanjo SAN – The Honourable Attorney General/Commissioners for Justice;
ii. Mr. Tunjo Bello – The Commissioner for Water Resources and Environment;
iii. Mr. Segunn Dawodu – The Commissioner for Youth and Social Development;
iv. Mrs. Shulamite Adebolu – The Commissioner of Tourism, Arts, and Culture; and
v. Mrs. Ajibola Ponnle – The Commissioner for Establishment, Training and Pensions.

The delegation was done in exercise of the powers conferred by Section 45 (1) of the Land use Act, Cap. L5, Laws of the Federation of Nigeria 2004. For the avoidance of doubt, the section provides as follows:

“S. 45. (1) The Governor may delegate to the State Commissioner all or any of the powers conferred on the Governor by this Act, subject to such restrictions, conditions and qualifications, not being inconsistent with the provisions, or general intendment, of this Act as the Governor may specify; (2) Where the power to grant certificates has been delegated to the State Commissioner such certificates shall be expressed to be granted on behalf of the Governor.”

According to the notice, it may be cited as the Land Use Act (Delegation of Powers) Notice No. 001 of 2019 and shall come into force on the 20th day of September, 2019.
