Jenni Hermoso has filed a legal complaint regarding the kiss by the President of the Spanish Football Federation, Luis Rubiales. Rubiales kissed Hermoso on the lips after Spain’s World Cup final victory, which she claims was not consensual.

Rubiales asserts that the kiss was “mutual” and “consensual,” but he has been provisionally suspended by FIFA, the world governing body of football.

This complaint opens the possibility of the 46-year-old facing criminal charges. On August 29, Spanish prosecutors initiated a preliminary investigation to determine if the incident constitutes sexual assault.

At that time, Spain’s highest criminal court launched its inquiry based on the unequivocal nature of 33-year-old Hermoso’s statements, deeming it necessary “to establish their legal significance.”

A statement explained, “Given the public statements made by Jennifer Hermoso, the sexual act she experienced with Luis Rubiales was not consensual.” It also mentioned that legal experts would reach out to her “to provide her with the option of pursuing legal action and to inform her of her rights as a potential victim of an alleged sexual assault if she wishes to file a complaint.”

The statement further noted, “To proceed with a case of sexual assault, harassment, or sexual abuse, it will be necessary for the injured party or their legal representative to file a lawsuit or contact the public prosecutor’s office.”

Reportedly, Hermoso filed her complaint on Tuesday.

Rubiales, who, prior to the kiss, had been seen grabbing his crotch while celebrating Spain’s 1-0 win over England, has adamantly refused to resign from his position.

On Friday, Spain’s National Sports Tribunal (TAD) initiated a misconduct case against him, determining that he had committed a “serious offense” by kissing Hermoso. However, the TAD fell short of the “very serious offense” the government had requested, which would have resulted in his suspension.

In response to Rubiales’ continued tenure, 81 Spain players, including all 23 World Cup winners, have announced their refusal to play for the team. They are scheduled to participate in UEFA Nations League qualifiers later this month, with matches against Sweden and Switzerland on September 22 and 26.

On Tuesday, Spain’s World Cup-winning head coach, Jorge Vilda, who was considered a close ally of Rubiales, was dismissed, and Montse Tome was appointed as his successor.
