*Premises Prayer On The Objectives And Constitution of NBA

The Counsel for Joyce Oduah, the suspended NBA General Secretary, Murtala Abdul-Rasheed, SAN has prayed the NBA-NEC members to ensure they respect the pending case against the incorporated trustees of the NBA & Ors., suit no: FHC /ABJ/CS/1426/2022.

In a letter dated 18th August, 2022 addressed to the NBA-NEC Member by Murtala Abdul-Rasheed and made available to TheNigeriaLawyer, the learned silk made it known that his client, Mrs. Joyce Odauh is “the center gravity and engine room of NBA-NEC meetings” as the General Secretary and her purported suspension was illegally carried out and contravenes the NBA Constitution.

It was in line with these, that Joyce Oduah instituted the case against the Incorporated Trustee of NBA & Ors. The learned silk notified the council members that the case came up for hearing on 18.08.2022 before the Federal High Court, Abuja Judicial Division, Coram: Hon. Justice A. R. Mohammed, for hearing of the plaintiff’s s Ex-Parte application to which the defendant counsels were present.

Thus, according to the learned silk, the letter was to pray the NBA-NEC inline with the provisions of the NBA Constitution to do the following:

i. that all steps be taken by the NEC to ensure the pending litigation and proceedings of the Honourable Court is respected;
ii. that all parties to the pending litigation respect the rule of law and desist from taking any steps, action(s), move motion(s) and/or pass resolution(s)and/or not doing anything capable of jeopardizing and/or disrespecting the pending proceedings before the Honourable Court; and
iii. that the subject matter of the pending litigation, which is now caught by the doctrine of les pendens, is not discussed, put to vote , motion(s), resolution(s) and/or decided upon by the NEC;

Abdul-Rasheed SAN stated that this prayer was premised on the fact that the NEC were regarded as the fathers of the Bar and would uphold the rule of law without making exceptions.
