The Acting Commander of the Ibadan Zonal Command of the Economic and Financial Crimes Commission (EFCC), ACE Halima Mustafa Rufa’u, has clarified that securing administrative bail for suspects in EFCC custody is free of charge.

This statement comes as the EFCC aims to ensure transparency and proper legal procedures in its operations.

On Wednesday, August 16, 2023, ACE Halima Mustafa Rufa’u met with Executive Committee members of the Ibadan Branch of the Nigerian Bar Association (NBA), led by its Chairman, Folashade Aladeniyi. During the meeting, Rufa’u emphasized that the EFCC does not impose any fees on lawyers or family members seeking the release of detained suspects on bail.

The clarification was made public through a press release signed by Wilson Uwujaren, the Head of Media & Publicity at the anti-graft agency. According to the release, Rufa’u cautioned lawyers against the practice of simultaneously acting as “surety” and legal representatives for suspects. Such actions, she noted, not only risk legal consequences for the lawyers themselves but also cast a negative light on the legal profession as a whole.

Rufa’u also highlighted the importance of accountability in the administrative bail process. If a suspect is released on bail and subsequently breaches the terms, the EFCC will take action by first arresting the lawyer who stood as surety, followed by other sureties involved.

The meeting between the EFCC and the NBA is seen as a positive step towards fostering collaboration and synergy between the two entities. The NBA Chairman, Folashade Aladeniyi, commended the EFCC’s efforts in tackling cybercrime and financial fraud activities in Oyo State. Aladeniyi also praised the Commission’s track record of securing convictions related to economic and financial crimes.

While acknowledging the EFCC’s achievements, Aladeniyi urged the Zonal Commander to ensure the protection of suspects’ rights while in detention. She further called for thorough investigations into allegations of corruption involving politically exposed individuals in the state.

The meeting reflects the commitment of both organizations to upholding the rule of law and promoting accountability in the fight against economic and financial crimes.
