Daily Law Tips (Tip 532) by Onyekachi Umah, Esq., LLM. ACIArb(UK)

DURATION OF SICK LEAVE WITH PAY IN NIGERIA.

Sickness is the state of being ill. Workers in Nigeria, are by law entitled to a particular duration of sick leave with pay(salary). So, no employer can deny or reduce the stipulated period of sick leave for any worker in Nigeria. This applies to any worker in Nigeria; public (government) or private sectors.

By law, a worker in Nigeria is entitled to wages/salary for up to 12 days in any one calendar year(January to December) during the worker’s absence from work caused by temporary illness certified by a medical practitioner. So, a worker is entitled to sick leave with pay provided the worker is still employed (has running employment agreement) and would have worked but for the illness, and also the worker is willing to be examined by a medical practitioner nominated by his employer.

My authorities are sections 16, 91 and 92 of the Labour Act of 1974.
