Daily Law Tips (Tip 408) by Onyekachi Umah, Esq., LLM. ACIArb(UK)
DO YOU REALLY NEED APPROVAL OF “FCDA” TO MAKE DEVELOPMENT IN ABUJA.
Sights of “Stop Work” inscription is common on construction sites across Abuja.
No person (individual or corporate) is allowed to commence development of any property within the Federal Capital Territory without a written consent from the Federal Capital Development Authority(FCDA). Hence, the FCDA has powers to order any person to stop work and even remove his development. Where development is not removed as ordered by FCDA, the FCDA can carry out such removal and recover the expenses from the owner as debt. Note that development includes, construction, building, mining or engineering over, in , below and top of land or water.
My authorities are sections 7, 20 and 21 of the Federal Capital Territory Act, 1976.
