The Lagos State Special Offences Court, Ikeja, has sentenced Ojora Sulaiman Kehinde to seven years’ imprisonment for fraudulently converting ₦81.3 million belonging to Sterling Bank Plc. Justice Mojisola Dada, who delivered the judgment on Friday, also directed the prosecution to pursue all legal means to ensure full restitution of the stolen funds.

The court’s ruling was sharply critical of the defence counsel, whom Justice Dada described as a “pathological liar,” raising concerns about his professional ethics and conduct during the trial.

The case, FRN v. Ojora Sulaiman Kehinde (Charge No: ID/20131C/2022), was instituted by the Economic and Financial Crimes Commission (EFCC) over allegations that Kehinde exploited a temporary technical malfunction in Sterling Bank’s electronic transfer system. Evidence presented showed that the glitch allowed customers to initiate transfers exceeding their actual account balances.

On May 17, 2022, Kehinde, who had a balance of only ₦3,000, transferred ₦500,000 in three tranches to his wife’s account. He later carried out similar transactions, cumulatively diverting ₦122 million directly to his wife, while additional sums were sent to other beneficiaries. Sterling Bank’s investigation traced ₦178.2 million, recovering ₦68 million, leaving an outstanding ₦81.3 million yet to be recovered.

During the trial, the prosecution presented witnesses, including a Sterling Bank representative, alongside documentary evidence detailing the fraudulent transactions. Kehinde did not call any witnesses in his defence.

Justice Dada held that Kehinde had clearly and dishonestly converted the bank’s funds with intent to permanently deprive it of its property, meeting all legal requirements for conviction under Section 280(2), punishable under Section 287 of the Criminal Law of Lagos State, 2015.

The judge’s verdict emphasized both the severity of the offence and the need for restitution, instructing the prosecution to ensure that Sterling Bank recovers the remaining ₦81.3 million.
