A High Court sitting in Lagos on 27th July, resumed hearing on the case of the Killers of popular Anambra billionaire and owner of Fireman Generator, Chief Ignatius Odunukwe.

The three accused persons Daniel Ibeaji, Uzor Igwe Arinze, and Cletus Solomon were produced in Court, by the State prosecutor.

The counsel to The 1st accused person, C.J Jiakponna Esq,  intimated the Court of his pending application before the Court, however, Counsel to the Ist accused person moved his application for a comprehensive production of the medical condition/report of the 1st accused person (Daniel Ibeaji) by the correctional center Ikoyi.

The motion was granted and his lordship Honourable Justice Adesanya ordered that test results on his medical condition must be provided before the court within 14 days from that day.

His lordship further reiterated that The status of the medical condition of the accused person is necessary if bail will be granted.

However, he noted that it is a capital offence, and granting bail, in this case, can only be on serious health condition which the Ikoyi correctional center medical facility cannot handle.

Justice Adesanya,  further adviced that if the counsel to the accused persons are coming by way of plea bargaining they should do so in time, not when trial has commenced nor at the closure of the prosecution’s case hence such will be discarded and that the magnitude of the offences is such that needs to be put into consideration.

His lordship also said that plea bargaining is Lagos state practice and is only applicable in rape cases and therefore, plea bargain will not be entertained.

The matter was adjourned to 28th October, for the continuation of the hearing.
