The judgment delivered on July 4, 2024, the Federal High Court in Abuja has ruled that 381 Ad-Hoc delegates elected during the Peoples Democratic Party (PDP) ward congresses on February 4, 2024, are the lawful delegates to participate in the party’s Edo State governorship primaries.

Justice I. E. Ekwo, in his judgment, declared that the plaintiffs, Hon. Kelvin Mohammed, Mr. Gabriel Oscy Okoduwa, and Mr. Ederaho Osagie, along with 378 other delegates whose names appear on the election results, are the validly elected ward delegates as per the provisions of the PDP Constitution.

The court directed the Independent National Electoral Commission (INEC), PDP, and its National Secretary to abide by the outcome of the February 4, 2024 ward congress and allow the 381 elected delegates to participate in the governorship primaries scheduled for February 22, 2024, or any other date.

Furthermore, the court restrained the defendants from unlawfully excluding the plaintiffs and the other elected delegates from participating in the primaries.

Justice Ekwo found that the PDP failed to comply with its Constitution, the Electoral Act 2022, and its own Electoral Guidelines for Primary Elections in the purported ward congresses from which the party’s “Summary of Result Sheets for Elected 3 Ad-Hoc-Ward Delegates” emanated.
