The High Court of Lagos State, presided over by Justice Olufunke Sule-Amzat, has restrained the Chairman of Kosofe Local Government Legislative Council, Moyosore Ogunlewe, and the leadership of the council’s legislative arm from taking disciplinary action against a councillor representing Anthony Village, David Olugbenga Samuel, following his role in exposing alleged financial misconduct within the council.

The judge issued the interim order on March 10 while ruling on an ex parte application filed by the councillor through his counsel, Olugbenga Ajala, in a suit marked LD/21415MFHR/2026 before the Lagos State High Court.

Other respondents in the suit include the Leader of the Legislative Council, Isiwu Charity; Oyedile Olufemi; the Nigeria Police Force; and the Area Commander of Area H Command, Ogudu, Lagos.

In a 27-paragraph affidavit supporting the application, Samuel alleged that the council chairman and some legislative leaders launched a politically motivated campaign of intimidation against him after he submitted a petition to the Lagos State House of Assembly.

The petition, dated December 2, 2025, was jointly filed with two other councillors — Abayomi Elugbidin and Sulaimon Baruwa.

According to Samuel, the petition accused Ogunlewe of undermining the democratic process in the council by appointing “shadow councillors” to perform the duties of elected officials, withholding statutory allowances, and allegedly using threats and intimidation against elected representatives.

The petition also raised concerns over the alleged misappropriation of a ₦100 million empowerment fund, which the councillors claimed was distributed through individuals who were not elected members of the legislative council.

Samuel further told the court that on December 19, 2025, a separate petition surfaced accusing him of sexual harassment.

The petition, filed by one Idowu Charity, was described by the councillor as false and politically motivated.

He maintained that he had only encountered the petitioner once in a public setting. He alleged that the accusation was fabricated to tarnish his reputation and derail his political career following his allegations of financial misconduct within the council.

After considering the application, Justice Sule-Amzat granted an interim injunction restraining Ogunlewe, Olufemi, and the legislative council from suspending or expelling Samuel, deducting his salary or benefits, or taking any disciplinary action against him pending the determination of the substantive suit.

The court also restrained the Nigeria Police Force from arresting or detaining the councillor over the sexual harassment petition, noting that the matter is already under investigation by the Force’s Criminal Investigation Department Annex in Ikoyi.

Justice Sule-Amzat further directed the respondents not to take any further steps regarding the petition filed against Samuel until the originating motion on notice is determined.

The case was subsequently adjourned to March 17, 2026, for further hearing.
