A recent ruling by a Chief Magistrate in Ile-Oluji, Ondo State, has sparked outrage and disbelief on social media. The case, involving the alleged theft of cocoa from a farm, has drawn attention due to the unusual circumstances surrounding the conviction.

According to the certified true copy of the court proceedings, the defendant, Benjamin Andrew, was arraigned before the Chief Magistrate’s Court on three counts of stealing cocoa. Despite pleading not guilty to all charges, the defendant was swiftly convicted and sentenced to three years imprisonment for each count, with the sentences to run concurrently.

The court document reveals that the complainant claimed this was the second time he had caught the defendant stealing cocoa from his farm. A police officer, Corporal Akinniyi Pious, corroborated the complainant’s statement, stating that the defendant had previously been arrested and brought to the station for a similar offense.

However, the defendant maintained his innocence, denying the allegations of theft.

In his ruling, the presiding Chief Magistrate, Dr. Tope Aladejana, noted the prevalence of cocoa theft in the area and emphasized the need for the court to take action before the situation escalates. Despite the defendant’s not guilty plea, the magistrate found the evidence against him sufficient to warrant a conviction.

The ruling has drawn criticism from legal experts and the general public alike. Chidi Odinkalu, a prominent figure on X (formerly Twitter), expressed disbelief at the court proceedings, questioning the credentials of the magistrate who bears the title “Dr.”

Odinkalu wrote, “Someone shd pls say that this did not happen. Surely not with a Magistrate that answers ‘Dr….’ I do not imagine that the Dr. there means Dr. of Magisterial Homeopathy?”

The controversial ruling has raised concerns about the fairness and integrity of the judicial process in the Ile-Oluji Magisterial District. Legal experts have called for a thorough investigation into the matter to ensure that justice is served and the rights of the accused are protected.
