Emmanuel Okeke a residence of Onitsha has filed Notice of Consequence of Disobedience of Court Order against Enugu Electricity Distribution Plc (EEDC) officials. This is sequel to failure of (EEDC) to obey an order made on 4th July 2018, by a high court sitting in Onitsha, directing parties to maintain status quo ante bellum. The Plaintiff, Mr. Emmanuel Okeke commenced action against EEDC over illegal disconnection of electricity supply in a Commando Style without delivery of a correct Bill by the defendant and a written warning/notice of the said disconnection given to the plaintiff. The plaintiff sought the following reliefs: A DECLARATION that pursuant to section 5(f) of Nigerian Electricity Regulatory Commission’s Connection and Disconnection Procedures for Electricity Services 2007, it is illegal to disconnect plaintiff’s electricity supply in a Commando Style without delivery of a correct Bill by the defendant and a written warning/notice of the said disconnection given to the plaintiff. A DECLARATION that pursuant to section 2(3) of Nigerian Electricity Regulatory Commission’s (Methodology for Estimated Billing) Regulations 2012, the defendant is bound to adopt the NERC methodology for electricity Billing and under no circumstances shall the bill be arbitrarily inflated by the defendant. A DECLARATION that pursuant to section 1(1) & (2) of Nigerian Electricity Regulatory Commission’s (Meter Reading, Billing, Cash Collections and Credit Management for Electricity supplies) Regulations 2007, the defendant issued illegal estimated bills to the Plaintiff by the defendant’s failure in complying with the laid down procedure of the Regulation. AN ORDER directing that plaintiff’s Electricity Bills to be reviewed by an independent professional/body in accordance with NERC approved regulation on estimated Billing methodology as the said bills are clearly excessive, offensive and illegal. AN ORDER nullifying plaintiffs’ electricity Bills together with the arrears contained therein issued to the plaintiffs as same is fictitious, vexatious, unfounded and illegal. AN ORDER directing the defendant to forthwith deliver to the plaintiff pre-paid meter as he has duly applied for same or in the alternative charge a sum not exceeding N3, 000 monthly for electricity consumed by the plaintiff. A PERPETUAL INJUNCTION restraining the defendant from disconnecting plaintiff’s electricity supply either by cutting of wires or by removing of Cut Out fuse or any means whatsoever without delivery of a correct Bill and a written warning thereof as required by law. GENERAL DAMAGES in the sum of N5, 000,000.00 (Five Million Naira). SPECIAL DAMAGES assessed at N212,000.00 (Two Hundred and Twelve Thousand Naira) at N2, 000 daily as cost of fuel to run generator from 5th February 2017 until 7th May 2017 and from 24th October 2017 till 8th November 2017 when plaintiff’s electricity supply was re-connected. 35% interest per annum (or prevailing CBN Interest Rate) of the judgment sum from date of delivery of judgment until final liquidation of the judgment debt.
