Daily Law Tips (Tip 397) by Onyekachi Umah, Esq., LLM. ACIArb(UK)

BLINDFOLDING, PROLONGED INTERROGATION, DENIAL OF SLEEP, SOLIDARITY CONFINEMENT AND SECRET DETENTION CENTERS ARE ILLEGAL IN NIGERIA.

In all parts of Nigeria and across all security agencies, it is unlawful and illegal to blindfold any person, suspect, accused person or detainee. Also, prolonged interrogation/questioning, denial of sleep/rest, solitary confinement and detention at secret detention places are illegal and unlawful. No security agency or organisation is permitted to do such even on high profile cases and national security cases.
Punishment for doing any of the above listed illegal conducts as well as any act of torture is 25 years imprisonment. And, anyone tortured is entitled to compensation and public apology among other things.

My authorities are sections 2, 3, 7, 8, and 13 of the Anti Torture Act, 2017 and section 35(6) of the Constitution of the Federal Republic of Nigeria, 1999.
