The planned hearing of the application for the extradition of suspended DCP Abba Kyari to the United States (US) was stalled owing to a request by the Attorney General Federal for time to file some documents.

At the mention of the case on Wednesday, AGF’s lawyer, Pius Akutah, sought more time him respond to processes just served by Kyari’s lawyer, Mahmud Magaji (SAN).

Akutah noted that although the court had, on the previous date, fixed hearing for April 27, he filed a motion for extension of time to respond in view of the delay on the part of Kyari’s lawyer.

Magaji did not object to Akutah’s request for time,following which Justice Ekwo adjourned til June 2 for a hearing.

The case experienced similar delay on May 23, 2022 when the was last mentioned.

Lawyer to Kayri at the proceeding, Nurieni Jimoh (SAN) informed the court that his client was yet to be served with the extradition application as required by law, a development Akutah confirmed.

Akutah said the applicant could not serve before now because of Kyari’s involvement with the National Drug Law Enforcement Agency (NDLEA).

He assured the court that the applicant would effect service on the respondent (Kyari) by March 24 and prayed the court for an adjournment.

Jimoh, who did not object to the application for adjournment, said he was entitled, under the court’s rules, to 14 days, from the date of service, to file a response.
Justice Ekwo then adjourned till April 27 for hearing.
