Senior Advocate of Nigeria and former National Welfare Secretary of the Nigerian Bar Association (NBA), Kunle Edun, has strongly condemned the recent arrest of a Director of Public Prosecutions (DPP) by police officers despite the DPP’s lawful entry of a nolle prosequi in a criminal matter.

In a statement made available to the press, Edun described the incident as “an unconstitutional aberration” and demanded urgent intervention from the Honourable Attorney General of the Federation (HAGF), who he stressed is the Chief Law Officer of the nation.
“This does not call for much talk,” Edun said. “The Honorable Attorney General of the Federation is the Chief Law Officer of the Federation. He should not remain silent on this issue. It touches on his office too. The HAGF should immediately tell the IGP to call his subordinates to order.”
Edun further emphasized that the Nigeria Police Force, which has a Legal Department headed by a Commissioner of Police, should not feign ignorance of the breach of constitutional procedure caused by the arrest.
“In Nigeria of today, every head of something is acting without direction and as if he is above the law,” he lamented.
The senior lawyer called for the immediate sanctioning of the officers responsible and urged the HAGF and the Police hierarchy to uphold the integrity of the law. He warned that failure to act may force the NBA to question whether these public officers have violated their oath of office and their professional obligations to the legal community.
“These two offices should be written to do what is right by bringing those officers to book. If they do not, then the NBA will have to consider if they have not violated the oaths of their office and their obligations to the legal profession,” Edun concluded.
