At the just concluded National Executive Committee Meeting held at Ilorin, Kwara State between 27th February, 2018  to the 1st March, 2018, the National Legal Adviser, Chief R.O. Balogun, presented a report of the activities of  the Bar that fall within the precinct of his office between  December, 2017 to  February, 2018.   In giving the report he craved the indulgence of the NEC members to adopt the report emanating from the Directorate of Legal Research and Development, contained in the Secretariat Report as his. This according to him was important to avoid unnecessary duplication of the report of various events. The report presented contained sittings of the Legal Practitioners Disciplinary Committee (LPDC). According to the report presented, the Legal Practitioners Disciplinary Committee had three sessions between the month of December, 2017 and the month of February, 2018 with the petitions at different stages on the Causes list of the LPDC. From the 4th day of December, 2017 to the 7th day of December, 2017, the report shows that a total of three petitions were listed for direction, thirteen for adoption of written address, one for motion, nine at the defense stage, nine for continuation of defence, and one for cross examination. Six petitions were reported to be at the stage of continuation of hearing, while twenty one petions were listed for hearing. From the 29th January 2018 to the 1st day of February, 2018, nine were listed for direction, four for adoption of written address, five for continuation of defence and ten for defence, eleven for continuation of hearing, seven for motion, eleven for hearing, and two for cross examination.   He noted that the third session of the LPDC has been fixed and the session will hold between 26th February, 2018 to March 1st 2018. As at Monday, 26th February, 2018, four matters were listed for ruling and direction, one for ruling and one for adoption of written address, one for continuation of defence and one for defence. As at Tuesday 27th, February, 2018, one petition was listed for adoption of written address, two for continuation of defence and three for motion. On 27th Tuesday, February, 2018, two petitions were at the stage of cross examination, two for continuation of hearing, and four for hearing. On Wednesday, 28th February, 2018, four petitions were listed for direction, one for ruling, two for adoption of written address, two for defence, one for motion, three for continuation of hearing, and two for hearing. Also on the 1st of March, 2018, two petitions were listed for direction, one for ruling and four for adoption of written address. Four were listed for defence, one for motion, one for cross examination, and four for hearing.   The review also shows that during the period, some directions were delivered by the LPDC. The petitions include the case of  BB/LPDC/207/16 N.B.A V. A. G Wakil Esq, BB/LPDC/201/16 N.B.A  V. PAUL OJEME ESQ and BB/LPDC/212/16  N.B.A  V.  IVIE ELEMA ESQ.  According to the report, some of the cases worthy of annotation are HOW/623/2016: IHEDIOHANMA FEDELIS AKPONYE ESQ V. NIGERIAN BAR ASSOCIATION & 2 ORS  which deals with the Owerri branch election matter as it has been agreed by the parties to be settled out of court and also the REGISTERED TRUSTEES OF NIGERIAN BAR ASSOCIATION V. OLASUPO OJO with APPEAL NO CA/A/362/2017. With respect to the Ojo’s case, the report presented that the Appeal was entered before the Court of Appeal Abuja on 30th May, 2017 and Mr. President in his wisdom constituted a Legal team headed by Prince Lateef Fagbemi SAN to prosecute the Appeal on behalf of the Trustees.  The distinguished Senior Counsel was of the view that this appeal ought not to be pursued because, it is a matter which ought to be resolved, more so when  the Registration Processes of the 2015 NBA Constitution commenced during Alegeh SAN’s Administration has been concluded and the Constitution now duly registered. In other words, in as much as the crux of the matter of Olasupo Ojo Esq is the non- registration of the Constitution, is the Appeal not academic and the entire matter rendered otiose by the Registration? , so it was asked. The National Legal Adviser affirmed that the matter came up on 19th February, 2018 for hearing of Motion on Notice for Stay/Injunction Pending Appeal filed by the Incorporated Trustees. However, the Respondent filed a Motion for the dismissal of the Appeal for want of Prosecution on Friday 16th February, 2018. The learned SAN representing Mr Ojo pressed to have the Motion moved on 19th Monday, 2018 when the motion was not even ripe for hearing. We believe this was done in acute bad faith and not in the interest of the Bar.  The Court granted an application for an adjournment sought by the Lead Counsel Prince Fagbemi SAN and the matter was adjourned to 28th June, 2018 for hearing of pending motions.  ]]>
