The Senior Advocate of Nigerian, made this statement at the Administration of Criminal Justice Conference held at the Transcorp Hilton hotel, Abuja on the 9th of November, while giving his goodwill message. According to him Nigeria`s criminal justice system has lost its capacity to respond quickly to the needs of the society. To check the rising waves of crime, speedily bring criminals to book, to protect the victims of crime, to protect both foreign and local investors who are scared away from investing in Nigeria because the machinery to protect investments from criminally minded persons is weak. “The negative effect of a weak criminal justice system on the socio-economic and political terrain of Nigeria is incalculable, it impedes economic development, invites anarchy, renders the society unsafe for hardworking and peace loving citizens. It also precipitates a destabilized Nigeria that is unsafe, unsecured, disorderly, lawless, and avoided both by foreign and domestic investors,” he said. Speaking further he said “ the ACJA introduces several innovative and progressive provisions which not only tackle the challenges the criminal justice administration in Nigeria, but also responds to Nigeria’s dire need to transform the criminal justice system to reflect the true intents of the Constitution and the demands of a democratic society, to ensure speedy trials and accelerated hearings in federal and state levels; to offer the opportunity to increase inter-agency co-ordination and cooperation among criminal justice institutions, to eliminate unacceptable delays in disposing of criminal cases, to guarantee uniform criminal justice practices, and improve the efficiency of criminal justice administration in the country. The ACJA seeks to harmonize the bifurcated criminal justice legislations in Nigeria so as to ensure uniformity and harmony.” Speaking on the domestication of ACJA Arthur, SAN pointed out that it is not automatic for all states. There is a requirement for State domestication or adoption before it can come into force in a State. Because of delay in states domestication, NBA has undertaken to promote widespread criminal justice reform, and ensure uniformity in its application by supporting the adoption of the ACJA in 28 States in three phases over thirty (36) months period. The NBA also seeks to facilitate smooth implementation of the ACJA regime, which the ACJA represents, by building stakeholders` capacity for change. “The domestication and implementation of ACJA entails herculean responsibility. It can only be achieved through collaborative partnership among stakeholders. I therefore call on all stakeholders to work together with a view to ensuring speedy domestication and implementation in the States that are yet to adopt it. In doing this let us bear in mind that the differences in legal systems, culture and customs of various States will be addressed by customizing and modifying relevant provisions of ACJA in the model laws to suit the peculiarities of States, without sacrificing the essential unifying and progressive elements of the principal legislation- the ACJA,” Arthur Obi-Okafor added. As the chairman of the committee, he assured the leadership of NBA that the team will continue to work towards the achievement of a more effective and efficient criminal justice system. He also said NBA Criminal Justice Reform Committee will hold its fifth (5th) NBA Criminal Justice Reform Conference in 2018 and they will organize three (3) National Conferences in 2018 with focus on Criminal Justice Reform. Each of the conferences shall be held in each quarter of the year in different parts of Nigeria. The conference shall focus on attainment of the major objectives of the ACJA. The first of the conferences would be held in January 2018. It would be aimed at a diagnostic review of the ACJA 2015 with a view to appraising its efficacy or otherwise and identifying areas of further reform.
