Senior Advocate of Nigeria, Musibau Adetunbi, SAN, has described the call by Muritala Abdul-Rasheed, SAN, Ph.D (popularly known as Murray) for the resignation or impeachment of NBA President Mazi Afam Osigwe, SAN, as “an obvious hypocrisy of the blind,” insisting that Murray’s true intention is not about justice but mischief.

In a statement titled “Murray And The Hypocrisy Of The Blind,” Adetunbi dissected Murray’s allegations against the NBA President, arguing that the senior advocate has already convicted Mr. President without a hearing.

Adetunbi challenged Murray’s demand for the NBA President to vacate office without investigation.

“Back in our undergraduate days, we were taught in our 200 level by our legal system law lecturer that even the Almighty God did not convict Adam without a fair hearing. But for Murray, my Learned Brother Silk has insisted that Mr. President must vacate office without any hearing.

“Obviously, the Attorney General of the Federation was not called upon to investigate, rather, in the court of Mr Abdul-Rasheed SAN, Mr President has already been convicted, all because of Bar politics,” Adetunbi stated.

Adetunbi provided a detailed analysis of the $2,000 allegation.

“In this allegation, the alleged donor is the Government of Borno State and the receiver is ‘every Senior Advocate who attended NEC’. The Chairman and Secretary of Egbe Amofin who are both Senior Advocates were in attendance in Maiduguri, and deducible from Abdul-Rasheed SAN’s narration, they also collected the dollars paid by the Government of Borno State.

“Also, the three major Aspirants to the position of the President of the Nigerian Bar Association were also in attendance, and from Abdul-Rasheed, SAN’s narration, each and everyone of them also collected this money since they are equally Senior Advocates.”

He listed the SANs who, according to Murray’s narration, also collected the money:

  • Aare Olagunju, SAN
  • Adetunji Osho, SAN
  • Aare Akinboro, SAN
  • Lateef Akangbe, SAN
  • Okusanya-Badejo, SAN

Adetunbi questioned the selective targeting of the NBA President.

“Since Abdul-Rasheed SAN viewed it as a crime upon which Mr President must be impeached, what are we going to do to every Senior Advocate who was in Maiduguri and who, according to him, collected this money? Or should we just punish Mr President alone simply because his name is ‘Afam’ and pardon every other Senior Advocate who collected the money? I leave the answer(s) to your conscience.”

Adetunbi argued that there was no crime in the alleged dollar distribution.

“For me, there is no crime or moral indictment in this allegation. The money here was given to various individuals who may collect or refuse to collect. For it to constitute a crime, it must have been taken without the consent of the owner, who to the best of my knowledge is either Borno State Government or Senator Sheu Kaka, SAN whose hospitality to his colleagues of the inner bar is now a matter of public discussion.

“Thus, calling for the head of Mr. President without calling for the heads of every other person who collected money shows that Murray’s true intention is not about justice.”

Adetunbi stated the true story he heard.

“The true story, which I heard, is that it was Senator Sheu Kaka, SAN who gave this money to his colleagues in the inner bar. Be it Sheu Kaka, SAN or Borno State Government, if the giving was voluntary, I cannot see any crime in it.

“The story went further to say that he (Senator Kaka, SAN) equally gave Kaftan to every male Senior Advocate that was in attendance. I have not heard that the Kaftan has been returned by any Senior Advocate. How could the money constitute bribery and Kaftan would not?”

Adetunbi addressed the issue of a SAN allegedly returning the money.

“If it was a crime, then the person who allegedly returned the money cannot lay claim to any innocence. It does not take a lawyer, let alone a Senior Advocate, hours or days to recognise the crime of stealing or bribery. And returning at the point it was allegedly returned could only grant the learned silk, who returned it, at best, a plea bargain and not exoneration.”

Adetunbi addressed the allegation that the NBA President declared he could not be neutral.

“An objective analysis calls on us to make a distinction between Mr. President and the ECNBA. Upon setting up the ECNBA, the integrity of the election lies so much with ECNBA. It defeats simple logic to assume that ECNBA is an appendage of Mr President.

“It was a section of Egbe Amofin, which included Abdul-Rasheed, SAN, that adopted one of the three candidates as its preferred candidate. Neither Afam Osigwe, SAN nor any leader from that part of the country complained then. Unfortunately, most of the people that were eager to interfere in what could be described as EBF affairs are the ones complaining of interference in Egbe Amofin’s affairs now.”

Adetunbi offered frank advice to Murray.

“My frank and honest advice for Abdul-Rasheed, SAN and his cohorts is that the forthcoming NBA Presidential Election cannot be won by setting out to destroy Mr. President for an obvious political reason.

“Mazi Afam Osigwe SAN, by the special grace of Almighty God, is our senior in the inner Bar. However, I make bold to say that in Yoruba land, he is our younger brother. Please, do not set out to destroy a person who is not up to your immediate younger brother in age because of NBA politics. For me, it goes beyond desperation, it is inhuman and cruel.”
