Justice Adefunmilola Demi-Ajayi of the Federal High Court sitting in Osogbo, Osun State, has ordered the arrest and imprisonment of Professor Mahmood Yakubu, former Chairman of the Independent National Electoral Commission (INEC), for contempt of court.

The order, delivered on Monday, September 29, 2025, came shortly before Professor Yakubu stepped down as INEC Chairman after completing his tenure in office.

According to the ruling, the former electoral umpire’s boss failed to comply with an earlier judgment directing INEC to relist the national officers of the Action Alliance (AA) led by Hon. Rufai Omoaje on its official website.

The suit, marked FHC/OS/194/2024, was filed by the Action Alliance and several of its state chairmen, who alleged that INEC had unlawfully removed their names from the commission’s portal despite valid court judgments affirming their leadership.

In the certified order obtained by Vanguard, the plaintiffs, through a motion dated May 14, 2025, sought an order committing both INEC and Professor Yakubu to prison for disobeying the subsisting judgment delivered on February 17, 2025.

Justice Demi-Ajayi, in her ruling, held that the actions of the defendants constituted clear contempt of court, stressing that court orders must be obeyed regardless of status or office.

The court consequently ordered the Inspector-General of Police to arrest Professor Yakubu and ensure he is charged for contempt within seven days. It also imposed a fine of ₩100,000 against INEC and Yakubu in favour of the plaintiffs.

Part of the order reads:

“The Inspector General of Police shall cause the arrest and shall charge the Defendants/Judgment Debtors for contempt and committal proceedings within seven days of this ruling.”

The plaintiffs in the suit include the Action Alliance, Professor Julius Adebowale, Engr. Olowookere Alabi, Barr. Chinwuba Zulyke, Oladele Sunday, Simon Itokwe, and Araoye Oyewole, for themselves and on behalf of 30 state chairmen of the party.

Meanwhile, following Yakubu’s exit from office on Tuesday, Mrs. May Agbamuche-Mbu, a National Commissioner, has assumed office as the acting INEC Chairman.
