The Employment and Labour Lawyers Association of Nigeria (ELLAN) has released its 2023 review highlighting significant events that shaped the country’s labour landscape.

The report covers major case law, legislation, regulations and disputes that defined employer-employee relationships last year. It also projects likely developments in 2024.

According to ELLAN, the post-COVID recovery and economic reforms of the new administration led to increased tensions between workers and employers. This manifested in a wave of strikes and litigation over welfare conditions and collective bargaining rights.

The National Industrial Court issued landmark judgments relying more on international standards to resolve these disputes. The report particularly highlights cases that whittled down monopoly of existing trade unions, upheld university autonomy over payment systems and permitted access to 50% pension savings.

On the policy front, ELLAN reviews changes by the National Housing Fund and Industrial Training Fund Acts to ease doing business and talent development. The report also covers new guidelines on additional pension benefits, national health insurance and remuneration order for lawyers.

As outlook for 2024, the employment lawyers predict industrial unrests over minimum wage negotiations and passage of the Employees Remuneration Protection Bill currently before the National Assembly.

“We project the FGN’s ability to maintain social dialogue and uphold rights will be severely tested as effects of reforms bite harder,” said Victoria Agomo general editor for the report. “The National Assembly also has a significant role to play.”

ELLAN is an association of labour and employment law specialists promoting ethical legal practice and sound workplace policies in Nigeria.
