*Two Divisions Of Court Of Appeal To Handle Election Appellate Cases Nationwide

In a bid to minimize political interference, the President of the Court of Appeal, Justice Monica Dongban-Mensem, has transferred all election petition cases pending before the court in 36 states to the Abuja and Lagos divisions.

Consequently, all appellate cases from state election tribunal judgments will now be heard in the two divisions instead of the 20 divisions of the court. This affects appeals on governorship, national and state assembly elections.

According to sources, Dongban-Mensem acted due to petitions from parties alleging compromise of tribunal judges by state governors who provided them logistics support. Some judgements were described as fraudulent and “purchased” in favor of certain parties.

The appellants expressed worry over getting justice if cases remained in states under the influence of governors. Hence, the transfer to restrict contact between governors and judges handling the appeals.

Investigations established some truth to the allegations as an unholy alliance was uncovered between some governors and election tribunal judges leading to perversion of justice. Some judges now face trials.

Subsequently, Dongban-Mensem ordered immediate transfer of all election appeal cases to Abuja and Lagos where monitoring of judges will be easier. The Abuja division will handle appeals from 19 northern states while 17 southern states cases move to Lagos.

The action is aimed at guaranteeing the independence, integrity and impartiality of the appellate court. The president is convinced having fewer divisions handle all cases will enable her effectively oversee the judges.

Parties and their counsel have complied and moved to Abuja/Lagos despite huge costs. Some welcomed the decision but lamented the financial implications. However, they believe it will ensure fair hearings.

The court is yet to confirm if Lagos election appeals will also transfer out given allegations against tribunals in the state. Stakeholders hope the transfers will renew confidence in obtaining justice at the appeal court.
