*Urge CJ to Ignore Assembly’s Probe Demand

Lawyers representing Ondo State Deputy Governor, Lucky Aiyedatiwa, have written the state’s Chief Judge, Justice Olusegun Odusola warning against the House of Assembly’s continued defiance of court orders in its bid to remove their client from office.

In a letter dated October 4th, the lawyers led by prominent Senior Advocate of Nigeria, Ebun-Olu Adegboruwa, urged the Chief Judge to disregard any request from the Assembly to constitute a probe panel against the Deputy Governor.

This follows two lawsuits filed by Aiyedatiwa challenging his planned removal and securing injunctive orders from the High Court in Akure and Federal High Court in Abuja.

The lawyers accused the Assembly of gross misconduct and violation of constitutional provisions guiding the impeachment of a Deputy Governor.

According to them, the purported notice of allegations served against Aiyedatiwa is invalid having not been personally served before commencing removal proceedings.

The Assembly also convened plenary and deliberated on the allegations before serving the notice, contrary to constitutional requirements.

The lawyers further argued the Assembly has exhausted the two sittings allowed under the constitution for the removal process and so lacks jurisdiction for any further sitting.

Additionally, they noted the Federal High Court’s restraining order prohibits the Chief Judge from complying with any request from the Assembly to probe the Deputy Governor.

The lawyers condemned the Speaker’s public threats against the Federal High Court judge as reckless and embarrassing.

While urging respect for the authority of the courts, the lawyers advised all parties to await full determination of the pending suits before taking further steps in the removal moves.

The letter has been served on the Chief Judge, Assembly and Ondo State Governor. The issue promises to be a major test of compliance with court orders by public institutions in Nigeria.
