*Claims a Total of N113,025,000 As Fines and Penalties.
*Prays Court to Order Sealing Of BEDC Facilities In Ondo Until Payment of Penalty

The Ondo State Government through the Office of the Attorney General of the Stste has instituted an action against the Benkn Electricity Distribution Company (BEDC) for failing to energise 33 transformers in the state thereby depriving the concerned communities of power supply.

In the action commenced at the Revenue Court sitting in Ondo Road and in which the Ondo State Government is represented by the State Electricity Regulatory Bureau (SERB), the State is claiming a total sum of one hundred and thirteen million, twenty five thousand Naira (N115,025,000) as fines and penalties against the Distribution Company for failing and neglecting to energise the said transformers for a period of 57days (from 9th of December to 4th of February, 2022).

In a statement made available to TheNigeriaLawyer and signed by Kola Adeniyi, S.A to the Attorney General of Ondo State, the action was instituted to protect the consumer rights of citizens of Ondo State from exploitation by BEDC.

The statement reads in part; “… the action was brought to protect the consumer rights of citizens of Ondo State from the unending exploitation by BEDC ripping off the people of funds without supply of power.

He noted that by virtue of part VIII Section 3(c) of Ondo State Electric Power sector Law 2020, any company which wilfully denies to connect a transformer after certification by National Electricity Management Services Agency commits an electricity infrastructure expansion sabotage infraction and liable to a fine of Two million Naira (N2,000,000) in the first instance and N25,000 per day while the infraction continues.”

He further noted that the AG is praying the Court to order the sealing up of all BEDC facilities and stations within the State till the fines and penalties sought for are defrayed.

“The office of Attorney General of Ondo State is also seeking for an Order of the Court sealing the Defendant business premises, electrical power stations and ancillary facilities within Ondo State pending the payment of the fines/penalties imposed on BEDC.”

At the hearing of the case today, the Court noted that BEDC just filed their defence/application this morning, the Court therefore adjourned the case to the 16th of March, 2022 to enable the Attorney General of Ondo State respond to the application of BEDC.
