The Lawyers Network Against Corruption has issued a 24 hour Notice to the Corporate Affairs Commission to reverse its Directive requesting that applications for name reservation under Part C should first obtain the Registrar General’s consent.

In a Notice dated 13th July, 2020, LAWNAC argues that the directive encroaches on the Right to Freedom of Association guaranteed by Section 40 of the Constitution of the Federal Republic of Nigeria and the provisions of Sections 590 and 591 of the Companies and Allied Matters Act.

According to LAWNAC, “… the requirement for Consent under CAMA exists to regulate the use of restricted words in the formulation of names registered by the Commission. It is strange to presume that the Commission has classified the names and potential names of all Incorporated Trustees as restricted words.”

LAWNAC’s letter further states that this regulation would discourage the registration of non-profit organizations. The Network has threatened to go to Court if the Commission fails to reverse the policy within 24 Hours of receipt of their Notice.
