It is now commonplace, especially during this Covid-19 lockdown period, to find some Nigerian music artistes engage in quasi-nude/nude Instagram Live, where people call in to twerk or dance to music being played for some payment, to the full view of followers of the artistes who wish to watch the live videos.

It has become disturbing, and responses received so far from the artistes when backlashed by colleagues and other well-meaning persons, are quite regrettable, and to say the least, most disturbing. One responded as follows- “We set the trend, and they follow, am sure very soon they will copy me KING OF IDEARS.” In fact, such response reeks of crass stupidity and a very serious faux pas.

It becomes worse because these musicians have large followership, in their hundreds of thousands and even millions, and children are included. The solution to this disturbing trend is in law, but again, the Nigeria Police has failed to do its job. Sections 134 and 136 of the Criminal Law of Lagos State 2011, explicitly provides that-

Section 134 (Indecent Acts) “Any person who: (1) wilfully and without lawful excuse does any indecent act in any public place; or … is guilty of a misdemeanour, and is liable to imprisonment for two years.”

      Section 136 (Indecent Practices) “Any person who commits any act of gross indecency with another person in public, or procures another person to commit any act of gross indecency in public with him or another person is guilty of a felony, and is liable to imprisonment for three years.”

These provisions are encompassing enough to cover what happens on Instagram Live. They are indeed gross indecent acts and practices that offend morality. Thus, where an artiste is arraigned and prosecuted in court, a sentence of five (5) years imprisonment will be handed down; and where the sentences on the two criminal charges are to run concurrently, as always is, three (3) years imprisonment becomes what such an artiste must face, and interestingly, without an option of fine.

With the speed of development on the internet, it is high time the Police established a Social Media Unit (SMU) to deal with crimes committed on the social media space, to wit: public display of nudity, smoking of Indian hemp –which has serious criminal consequences under the Indian Hemp Act, threat to life, assault, amongst others.

Presently, with evidence which abound online, the Police should prosecute and obtain conviction against, at least four (4) popular music artistes, and few popular non musicians (some video vixens and so-called models and influencers) who participated in the recent nude Instagram Live videos. Finally, with the very real likelihood of the extension of the lockdown period because of the Covid-19 pandemic, it is certain that such Instagram Live videos will continue in same fashion. I humbly call on the Police, especially in Lagos State, to do the needful and put a stop to this online societal menace.
