A high court sitting at Ogidi, in Anambra state has sentenced Ejike  Nwankwo Ohagba  to death by hanging for killing his mother, late Christiana Nkwankwo.

Justice Peter Chudi Obiorah, found him guilty on one count charge of murder and convicted him on the same charge.

In the suit marked “AG/31C/2016, Justice Peter, said the prosecution was able to prove with cogent evidence that the convict intentionally killed the deceased.

The judge rejected the defendant’s plea of not guilty, noting that based on the evidence before him, such plea was not plausible and that the prosecution was able to establish all the ingredients of culpable homicide as provided for in the Criminal code Law Cap. 36 0f the Revised Laws of Anambra state.

He said the offence contravened sections 273(1) of the Criminal code Law Cap. 36 0f the Revised Laws of Anambra state  and is punishable under section 274(1)

“I am convinced from the evidence led by the prosecution that it was the Defendant who killed his mother. It is therefore clear the prosecution has established that it was the Defendant who caused the death of the deceased.

“The 3rd ingredient which the Prosecution must establish in a charge of murder is that the act or omission of the Defendant which caused the death of the deceased was intentional with knowledge that death or grievous bodily harm was its probable consequence was proved by all the prosecution witnesses.

“I have no doubt whatsoever that the prosecution has proved beyond a reasonable doubt the charge against the defendant. The conduct of the defendant was deliberate and premeditated. I found the defendant guilty of the offence of murder of Christiana Nwankwo Ohagba on the 7th of April, 2016.

“It is a matter that does not admit any discretion by the Honourable Court.

“Consequently, the sentence of the court upon you, Ejike Nwankwo Ohagba is that you shall be hanged by the neck until you be dead and may the Lord have mercy on your soul,” the judgment read.

Ejike Nwankwo Ohagba, was accused and convicted of killing his mother with his fist and dumping her into a well and covered her corpse with heavy blocks, stones, and palm trees.
