In a ruling by the sitting judge, Justice Toyin Adegoke, the National Chairman of APC, Adams Oshiomhole who was joined in the suit, as the 2nd respondent with APC, as 1st respondent, Independent National Electoral Commission and Prophet Jones Erue as the 3rd and 4th respondents respectively and the plaintiff were ordered to maintain status quo and desist from submitting any list candidates from Delta State from the two factions to INEC till the substantive suit filled is heard. It will be noted that the Chief Cyril Ogodo-led State Working Committee (SWC), in the state and others had instituted an interlocutory injunction restraining APC, Adams Oshiomhole from submitting the list of candidates from Prophet Jones Erue faction to INEC. According to Justice Adegoke, she said since pre-election matters require accelerated hearings, made the following orders that “this matter shall be given an accelerated hearing owing to fact that it is a pre-election matter. All defendants are to take note of the tendencies of this suit. “Parties shall maintain status quo as at today, the 17th day of October 2018. That is the order of this court,” Adegoke ruled. Counsel to the applicants, Barrister O. J. Oghenejakpor, said that the implication is that, as at today, no list of candidates has been submitted to INEC and none will be submitted until we hear this case. “Technically, the court has granted an injunction restraining any person to nominate any candidate from Delta State for the 2019 election. The issue will have to await the substantive trial which is now fixed for 1st and 2nd November, 2018. “Court has also granted us an accelerated hearing so that the facts can be put to rest once and for all. It’s a healing process and I think if the National Executives could take opportunity of this process. This is what will bring the party together in Delta State.” Meanwhile, Counsel to the 1st and 2nd respondents, Barrister George Onaho, who challenged the jurisdiction of the court, said “The court has done the needful and in the view of the court, our objection challenging the jurisdiction of the court has to wait and be adopted together with our final written address after the substantive suit must have been heard. “So that necessitated the adjournment that was taken. The court ordered an accelerated hearing and gave two days to call in witnesses and deal with the case.” Meanwhile the Publicity Secretary of the Delta State chapter of APC, Sylvester Imonina, has described the restrain order as false and lies cooked to deceive party faithful. Speaking in a telephone conversation Wednesday, Imonina, said the story was geared towards causing disaffection in the party and amongst members of the public. “It is nothing but their usual lies of trying to deceive the public. There was a case filed by Pat Utomi and even O’tega Emerhor, filed one yesterday in Warri trying to get an injunction and the case was adjourned to the 22nd of this month. “While in Asaba, they filed a motion for injunction, the court refused to take the motion for injunction that is why the court adjourned the matter to 2nd and 3rd of November and ordered accelerated hearing of the matter. “So, no injunction was granted anywhere, it is their usual way of trying to fool members of our great party and the public. So, don’t take whatever you hear or they say. Just throw it into the dustbin. So that is the position, I tell you with all sense of responsibility.” He noted that the purported factions in the party is spread by unscrupulous elements who do not want APC to save the state from wanton backwardness the state has faced since 1999, “We do not have divided APC in Delta state, those who are saying there are two factions, they have been long expelled. “Secondly, it is not the responsibility of SWC to forward names to INEC, it is the responsibility of National,” he stressed]]>
