Court dethrones Dodo Wawa chief

From available records to the court and ruling by Justice Christopher Auta in 19/5/2009, the judge said there was nothing to show that the order issued has been set aside and as such there is nothing to show that the parties in the case have filed an Appeal against the order. Justice Abdul however held that the order of injunction made by Justice Christopher Auta still subsists until it is set aside by an appellate court, as the trial of the case De Novo does not ipso facto affect the order earlier made by the court. It would be recalled that on February 20, 2009, Ki-Ibrahim Dodo, who was the Dodo of Wawa died and sequel to his death, Mallam Mahmud Ahmed Aliyu was illegally elected as the new Dodo Wawa on February 28, 2009 by kingmakers of Wawa. According to him, “The election of Ahmed Aliyu is considered to be unilaterally constituted by the late Dodo for being one-sided in favour of his own ruling house (Kibe-Farandi family). The election was done without complying with the recommendation of Borgu Emirate Council”. Counsel to the Plaintiff, Idenyi Peter, while commending the Judge for his ruling, said the defendant must stop parading himself as the Dodo Wawa pending the outcome of the competent court of jurisdiction. “Justice Musa Abdul in his ruling delivered yesterday, not only reaffirmed the order of injunction, made by Justice Christopher Auta in 2009, but went further to validate the said order and warn the 3rd defendant in the case, Mallam Mahmud Ahmed Aliyu”. Against expectations of all interested parties, he said, “He has continued to occupy the palace of the Dodo of Wawa with the protection of the Police and continued to officially function in that respect, which in all respects amount to further abuse and disobedience of the order of the honourable Court”.]]>
