Osun State Government on Monday raised objections to the relocation of a suit it filed to stop the release of withheld local government allocations into the accounts of court-sacked APC Chairmen and Councillors.

The state queried the transfer of the case from Osogbo to the Abuja division of the Federal High Court, alleging bias on the part of Chief Judge Justice John Tsoho and insisting there was no urgency to justify hearing the matter during the court’s vacation period.
During proceedings, counsel to Osun State, Mr. Musibau Adetunbi, SAN, representing Attorney General Oluwole Jimi-Bada, urged the court to refrain from further action on the case. He highlighted two motions filed on August 25: one challenging the relocation of the matter from Osogbo to Abuja and the other seeking to delist the Attorney-General of the Federation (AGF) as the third defendant, leaving the Central Bank of Nigeria (CBN) and the Accountant-General of the Federation as the first and second defendants.
The state explained that it had already initiated a separate suit against the AGF at the Supreme Court, citing attempts by the AGF to release local government funds to illegal and sacked APC Chairmen and Councillors. “Some of the facts, questions, and issues to be addressed at the apex court would be identical to those before the trial court,” the notice of discontinuance read. Osun State prayed the court to stay further proceedings pending determination of the Supreme Court suit, marked SC/CV/773/2025.
Representing the AGF, Mr. Akin Olujimi, SAN, argued that the AGF had a right to be heard before being delisted, noting that he had filed a counter-affidavit challenging the competence of the suit and a motion to set aside an earlier interim order in favor of the plaintiff.
Counsel to the CBN, Mr. Muritala Abdulrasheed, SAN, and to the Accountant-General, Tajudeen Oladoja, SAN, accused Osun State of deliberately delaying the matter to allow the tenure of the Chairmen and Councillors to expire. Abdulrasheed noted, “The tenure of the Chairmen and Councillors will expire on October 22, and if this matter is not heard expeditiously, it will become a mere academic exercise.”
Justice Emeka Nwite adjourned the case to September 22 for hearing, stating that the motion challenging the court’s jurisdiction would be decided first. In the suit, Osun State had sought an interim injunction restraining the defendants from opening or operating local government accounts in favor of sacked APC officials and requested that the CBN and AGF be restrained from disbursing allocations to them.
